Terms of Service

These Terms of Service govern your use of Shotloom ("the Service"), an AI-powered video and image generation platform operated by SMF Vision Labs Private Limited, a company incorporated in India, GSTIN 36ABUCS1748K1ZL ("we", "our", "us"). Shotloom is a brand of SMF Vision Labs Private Limited, and that company is the seller and the contracting party for everything you purchase here. By accessing or using Shotloom, you agree to be bound by these terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use Shotloom. By using the Service, you confirm that you are 18 or older and legally capable of entering into a binding agreement.

2. Account Registration

Shotloom uses Google Sign-In for authentication. Your Google email address serves as your account identifier. You are responsible for all activity that occurs under your account. You must notify us immediately at support@shotloom.ai if you suspect unauthorized access to your account.

You may not create multiple accounts to circumvent credit limits or platform restrictions. We reserve the right to terminate duplicate accounts without notice.

3. Credits and Payments

Shotloom operates on a credit-based system. Credits are purchased and used to generate AI content. By purchasing credits, you agree to the following:

Top-up credits do not expire and carry over month to month, subject to the dormancy clause below. Subscription plan credits expire at the end of each billing cycle. They refresh at the start of every cycle and any unused balance from the previous cycle is forfeited. This applies to all plans.
The maximum credit balance per account is 25,000 credits. Purchases that would exceed this limit may be declined.
Credits are non-transferable between accounts.
All prices are displayed in Indian Rupees (₹) unless otherwise stated. International pricing may vary.
Payments are processed securely through our payment provider. Shotloom does not store your payment card details.

Personal use only. Credits are issued for your personal or business creative use. Reselling, sublicensing, or commercially redistributing credits or platform access to third parties on a fee basis, without a separate written API or reseller agreement with Shotloom, is prohibited and may result in immediate account termination without refund.

One account per user. Each Shotloom account is for use by a single registered user. Sharing account credentials with multiple individuals is not permitted and may result in suspension.

Chargebacks and disputes. If you raise a payment dispute or chargeback with your bank or payment provider, Shotloom reserves the right to deduct the value of credits already consumed from any refund amount, and to suspend your account pending resolution of the dispute.

4. Refund Policy

Credits are non-refundable once purchased, except in the following circumstance:

If a generation fails due to a technical error on our platform or our AI provider's infrastructure, the credits charged for that generation will be automatically refunded to your account balance within minutes.

We do not offer refunds for: dissatisfaction with AI-generated outputs, outputs that do not match your expectations, unused credit balances, or purchases made in error. Please review the platform and use your free credits before purchasing.

5. Credit Dormancy

If your account has no login activity for a period of 12 consecutive months, your account will be considered dormant and credits will be temporarily frozen, not deleted. We will send warning emails at the 9-month and 11-month marks.

If no login is recorded after 13 months of inactivity, your unused credits may be forfeited. Shotloom is not liable for forfeited credits where warning emails have been sent. You may reactivate your account at any time before forfeiture by logging in.

6. Credit Cost Adjustments and Infrastructure Pricing

Shotloom's generation infrastructure relies on third-party AI services including Google Cloud Vertex AI (Veo, Imagen). The credit cost per generation reflects the current cost of this infrastructure. If our underlying AI provider costs change materially, including changes to Google Cloud pricing, Shotloom reserves the right to adjust the number of credits required per generation or the price of credit packs.

In such cases, Shotloom will:

Provide a minimum of 30 days' advance written notice to registered users via email before any generation cost adjustment takes effect.
Honour all previously purchased credits at generation rates applicable at the time of purchase for a minimum of 90 days following any such adjustment.
Allow users to request a pro-rata refund of unused purchased credits within 14 days of a pricing change notification, if they do not wish to continue under revised rates.
Only pass on adjustments greater than 20% change in per-generation cost. Minor fluctuations will be absorbed by Shotloom where reasonably possible.

Service discontinuation. In the event Shotloom discontinues the platform, a minimum of 90 days' notice will be provided to all users with active credit balances, and a pro-rata refund of unused purchased credits will be offered at the original purchase rate.

7. AI-Generated Content

Shotloom uses third-party AI models to generate video and image content. You acknowledge and agree that:

AI-generated content may be inaccurate, inconsistent, or not match your expectations. Shotloom makes no guarantee of output quality.
You are solely responsible for reviewing all generated content before publishing, distributing, or using it commercially.
Shotloom is not liable for any loss, damage, or legal claim arising from your use of AI-generated content.
Generated content must not be used to defame, harass, deceive, or harm any individual or group.
You must not use the Service to generate content that is illegal, obscene, or violates the rights of any third party.

8. Content Ownership

Subject to these Terms, you retain ownership of the outputs you generate using Shotloom, provided your use of the platform is in compliance with these Terms. Shotloom does not claim ownership of your generated content.

By using the Service, you grant Shotloom a non-exclusive, royalty-free licence to store, process, and display your generated content solely for the purpose of operating and improving the platform. We will not publicly display your content without your consent.

9. Prohibited Uses

You agree not to use Shotloom to:

Generate content depicting minors in any sexual or harmful context.
Create deepfakes or non-consensual synthetic media of real individuals.
Generate content designed to incite violence, hatred, or discrimination.
Attempt to reverse-engineer, scrape, or exploit the platform's AI infrastructure.
Resell access to the platform or API without written authorisation from Shotloom.
Use automated scripts or bots to generate content at scale without prior written agreement.

Violation of these prohibitions may result in immediate account termination without refund.

10. Account Termination

You may request account closure at any time by emailing support@shotloom.ai. Upon closure, your profile data will be deleted. Unused credits are forfeited upon voluntary account closure.

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice and without refund.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Shotloom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount of credits purchased by you in the 30 days preceding the claim.

12. Disclaimer of Warranties

Shotloom is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your requirements or expectations.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023 (DPDP Act). Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts of competent jurisdiction in India.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. GST and Taxation

All prices displayed on Shotloom are exclusive of Goods and Services Tax (GST) unless explicitly stated otherwise. GST at the applicable rate (currently 18%) will be added at checkout. The supplier of record is SMF Vision Labs Private Limited, GSTIN 36ABUCS1748K1ZL. A GST invoice is issued for every purchase and is available to download at any time from your account billing history. By making a purchase, you confirm that you are purchasing for use in India unless stated otherwise.

16. Data Protection | DPDP Act 2023

SMF Vision Labs Private Limited is the Data Fiduciary for personal data processed through Shotloom and complies with the Digital Personal Data Protection Act, 2023 (India). You have the right to access, correct, and request deletion of your personal data. To exercise these rights, contact our Grievance Officer at grievance@shotloom.ai. We acknowledge within 24 hours and respond within 15 days.

17. Grievance Officer

In accordance with the Information Technology Act, 2000 and the rules made under it, the DPDP Act, 2023, and the Consumer Protection (E-Commerce) Rules, 2020, a Grievance Officer has been designated to address your concerns:

Our response times. We acknowledge every complaint within 24 hours of receipt and resolve it within 15 days. Complaints concerning non-consensual intimate imagery or the impersonation of a real person are actioned within 24 hours. Where two sets of rules give us different periods, we apply the shorter one, so these times satisfy both the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020.

If you are not satisfied with our response on a personal data matter, you may complain to the Data Protection Board of India.
